29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access: a) Stairway Between the Fourth and Fifth Floor - Employees were using a portable job made ladder to gain access to the fifth floor and the top of the ladder extended only 10 inches above the landing surface, exposing employees to a 9 feet, 4 inch fall, on or about 07/13/2017. Oscar Cruz was previously cited for a violation of this occupational safety and health standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1214330, citation number 1, item number 2, and was affirmed as a final order on June 01, 2017, with respect to a workplace located at 1609 Lewis Street, NW Washington DC. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
