NYS Labor Law Section 27-a.3: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to the hazard of being infected with Mycobacterium Tuberculosis through unprotected contact with patients (inmates) who were infectious or suspected to be infectious with Tuberculosis in that: a)Two employees (S.T. and D.A.) were not periodically evaluated by TB Skin testing even if the NYC DOC classified the institutional aides as an "intermediate risk category", and therefore, to be skin tested once per year. (These two employees were missed during the initial inspection 124578386, and were identified based on the complete records provided by the NYC DOC on 07/13/2000) A feasible and useful abatement method for as recommended by the CDC, include but not limited to: Intradermal injection of tuberculin antigen (PPD) with subsequent measurement of the duration (Mantoux Method).
