OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to a blast and fragmentation hazard during an outdoors fireworks display. On July 4, 2017 at an outdoor field in Jeffersonville, crew members were exposed to a blast and fragmentation hazard while lighting fuses on mortar shells in racks and not moving away from the mortar shell when the fuse was lit. Feasible abatement: National Fire Protection Association (NFPA) 1123-2006 Code for Fireworks Display paragraph 8.2.6.2. stated that once a fuse is lit, the shooter shall vacate the mortar area.
