29 CFR 1910.132(d)(1)(i): The employer did not select and have each affected employee use, the types of personal protective equipment that would protect the affected employee(s) from the hazards identified in the hazard assessment: (a) The employer did not select and require the use of personal protective equipment that would protect employees from burns from 350 degree F oil, in that on June 21, 2017, two employees were dumping hot, used, fryer oil into the waste container behind the restaurant when it splashed on one employee, causing burns to the employee's legs, stomach, chest, arms and hands. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
