29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems: A Unload: On, or about, June 7 and 8, 2017, a Maintenance Technician performed servicing activities along the finish end of unload conveyors 2-1-2 and 2-3-2, approximately 8 feet 7 inches above the lower level and known to have an unprotected side or edge, and was not protected by one or more of the following methods of fall protection: guardrail systems, safety net systems, or personal fall arrest systems. B. Secondary 2 Platform: On, or about, March/April 2017, maintenance employees, trying to free a package stuck on the downward slope of a descending chute that was about 15 feet above the lower level, donned a body belt, and another maintenance employee used a rope to lower him down the chute, which was not compliant fall arrest/restraint equipment.
