OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while being elevated on a pallet being lifted by a forklift. a) 14 Juniper Lane, Albany, NY: On or about 6/20/2017, an employee was removing material from the top rack and was exposed to a fall of approximately 10 feet while working on a double pallet that was elevated by a forklift without fall protection.
