Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling materials: (a) On 5-30-97, employees engaged in loading fertilizer from a large overhead bin were exposed to the hazard of being struck by the storage bin because the supporting structure was badly rusted and corroded such that its strength and intregrity were compromised. Among other methods, one feasible and acceptable abatement method would eliminate the use of an overhead storage bin and load fertilizer directly from a conveyor or elevator into a truck.
