Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries in the event of a forklift or yard tractor tip-over accident because of the lack of employee restraint devices on the following forklifts/yard tractors: Komatsu, type G, serial #175124A, Komatsu, Type G, serial #173558, Hester, Type LP, serial #173750D, Komatsu Type G, serial #404532A, Komatsu, type G, serial #95203, Nissan, Type LP, serial #unknown, Komatsu, type LP. serial #C40BL, Komatsu, type LP, serial #176966A, Clark, Type LP, Serial #915 166 3030, Hester, Type LP, serial #unknown, Ibex Yard Tractor, registration #H-36516, and the Ottawa Yard Tractor, company designation ST1. a) Among other methods, one feasible and accepted means of abatement to correct this hazard would be to install seatbelts and require the use of them on all forklifts and yard tractors.
