Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: Establishment: Dock Area: Forklift operators were being exposed to crushing injuries in the event of a forklift tip-over accident because properly installed employee restraint devices on Komatsu 15 #65, serial #360643A and Komatsu 15 #69 Forklift, are not being used. The corrective abatement action would be to ensure the use of seatbelts on all forklifts within the terminal. CORRECTED DURING THE INSPECTION
