Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to falls associated with an unstable aerial lift in that: WORKPLACE: The employer did not comply with the manufacturer's specifications and limitations applicable to the operation of a JLG aerial lift, model 40 RTS 24, Serial number 0200032640, in that aerial lift was operated from the work platform in it's fully elevated position, on a surface that contained potholes and inclined, and this work practice exceeded the manufacturer's recommendations. Subsequently, on or about 4/30/2003, while operating the lift with the work platform fully extended in the air, two workers were injured when the lift was driven partially onto an inclined area while attempting to avoid some potholes. The lift tipped over and fell onto a parked tractor- trailer. The tractor driver also sustained an injury. Among others, one feasible method to abate this hazard is to establish and enforce adequate safe operating procedures. Procedures such as those recommended by the manufacturer, and to follow the safety guidelines in the American National Standard for Self-Propelled Elevating Work Platform (ANSI A92.6-1990).ed
