Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard multiple fracture and death due to sheet piles falling unexpectedly while being suspended in the vibratory hydraulic hammer of the MKT Geotechnical Systems V-5 B/HP-105 C Hydraulically Powered Vibratory Pile Driver/Extractor System: Location: 37 Coachlamp Lane, Stamford, CT 06901 On or About April 26, 2001 Among other methods, one feasible and acceptable abatement method to correct this hazard is to install positive stop safety slings from the block hoist line to the sheet piles or secure the sheet piles to the hoist line to prevent the sheet piles from unexpectedly falling while being held suspended in the vibratory hammer as well as instruct employees of this procedure.
