Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)On or about March 13,2001 at the work site located in the 1100 block of North Broadway on the west side of the roadway approximately 300 yards from the roadway, employees were exposed to the hazards of being struck by the swing radius of the track hoe or being caught between the swing radius and the tracks of the track hoe. Among other methods, one feasible and acceptable abatement method to correct these hazards is to install a barricade warning system around the swing radius of the track hoe.
