OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were operating ATV's without training were exposed to the hazards of being thrown from a moving vehicle and crushed in a rollover event: a. On or about May 15, 2017, an employee operating an Kubota 4400 All-Terrain Vehicle (ATV) on the north side of Hwy 90 near PX Ranch Road in Marianna, FL was exposed to rollover hazards in that the employee did not have proper training while operating an ATV.
