Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm, in that employees were exposed to severe multiple broken bones or possibly death while driving vehicles/golf carts: YARD: An operator of the Yamaha U-Max Medium Duty golf cart was not observing the speed limit posted on the blacktop roadway in between the old and new distribution centers/buildings and driving recklessly while another employee was "inappropriately" sitting on the passenger seat. On or about June 16, 2006, the employee, sitting on the passenger seat was ejected and thrown out from the seat due to the "unsafe" manner and "reckless" driving behavior of the golf cart operator. The "passenger employee" sustained severe fracture on the left ankle and head injuries from the incident. Among other methods, feasible and acceptable abatement methods to correct this hazard would be to follow the 2004 Edition of American National Standard Institute Standard, ANSI/NGCMA Z130.1-2004, Safety and Performance Specifications for Golf Cars, Part II, Section 8 Operating Safety Rules and Practices (Operator Qualifications), the safety operational instructions contained in the 2004 Yamaha Golf Car Operator's Manual G23A, 2nd Edition (P/N LIT-1962601-17) and have an authorized Yamaha Golf Car service center adjust or replace the car's engine speed governor so that the speed of the car can not exceed 10 miles per hour(mph). Those safety warnings and safety operational instructions include, but are not limited to: 1. Operation by authorized persons only, 2. Occupants/passengers shall sit firmly in the passenger seat with their feet firmly on the floor of the golf car.
