29 CFR 1910.146(c)(5)(ii)(C): Before an employee entered a space, the internal atmosphere was not tested with a calibrated direct-reading instrument for oxygen, flammable gases and vapors and potential toxic air contaminants: (a) On or about April 24, 2017, and at times prior, the employer did not ensure that employees required to enter permit required confined spaces (fermenters) to engage in yeast pushing activities monitored the internal atmosphere of the space prior to entering the fermenter. Oxygen content and potential toxic air contaminants, in the form of carbon dioxide were not monitored prior to entering the space. Fermenters G1, G2, and, G3, at approximately 7:35 AM, 8:00 AM, and 8:25 AM respectively in Cellar 13 were not monitored for oxygen content prior to entering the space. (b) On or about April 26, 2017, and at times prior, the employer did not ensure that employees required to enter permit required confined spaces (fermenters) to engage in yeast pushing activities monitored the internal atmosphere of the space prior to entering the fermenter. Oxygen content and potential toxic air contaminants, in the form of carbon dioxide were not monitored prior to entering the space. Fermenters D1, D2, and, D4, at approximately 6:20 AM, 6:45 AM, and 7:35 AM respectively in Cellar 13 were not monitored for oxygen content prior to entering the space. (c) On or about April 26, 2017, and at times prior, the employer did not ensure that employees required to enter permit required confined spaces (fermenters) monitored the internal atmosphere of the space prior to entering the fermenters for the placement and retrieval of cleaning jets and inspections of the spaces during and after the cleaning process. Note: There wasn't sufficient GfG G460 Multi-gas Detectors for employees to monitor the space at the time of the inspection and at times prior.
