OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized crush by and struck-by hazards that were causing or likely to cause death or serious physical harm to employees. On or about April 7, 2017, and at times prior thereto at the Willbanks Metals, Steel Distribution and Fabrication Facility located at 2400 N.E. 36th St, Fort Worth, Texas location, production employees used below-the-hook lifting devices that were not marked or rated exposing employees to crush-by and struck-by hazards. 1. Plasma Cutter employees used a crane to lift two un-rated shop made scrap bins. 2. Production employees used a spreader bar that was not marked indicating the rated capacity.
