Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall, crushed by, and struck by hazards. a) On or about April 12, 2017 and at times prior thereto employees used lift #1 Rotary Lift which had a seized safety lock that was not operational, the seal and bushing were bad, and employees were unable to determine the maximum rated capacity. b) On or about April 12, 2017 and at times prior thereto employees used Lift #2 Challenger lift which had extension arms missing stop bolts, which prevent the extension arms from falling out, or sliding out when a car is on the lift. c) On or about April 12, 2017 and at times prior thereto employees used Lift #3 Rotary Lift which had a seized safety lock, a missing cotter pin on the back left support pin, a leaking seal, the main piston had excessive movement, and employees were unable to determine the maximum rated capacity. d) On or about April 12, 2017 and at times prior thereto employees used Lift #4 Rotary lift which had a seized safety lock, the lift shifted back and forth, the metal cast seal ring was disintegrating, and employees were unable to determine the maximum rated capacity. e) On or about April 12, 2017 and at times prior thereto employees used Lift #5 Rotary Lift which had a seized safety lock, the lift was loose and shifted inside the seal due to a bad bearing and seal, and employees were unable to determine the maximum rated capacity. f) On or about April 12, 2017 and at times prior thereto employee used Lift #6 Rotary Lift, which moved uncommanded, had seized safety locks, contained excess grease and rust which prevented a complete inspection, and employees were unable to determine the maximum rated capacity. A vehicle fell from this lift while raised in the air on April 4, 2017. g) On or about April 12, 2017 and at times prior thereto employees used Lift #7, Rotary lift with Hunter alignment rack, which had seized safety locks, gouged hydraulic rams which showed damage to the pistons, and bad seals, and employees were unable to determine the maximum rated capacity.
