OSH ACT of 1970 Section (5)(a)(1): OSH ACT of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck by hazards. On 3/15/17, at the 1364 Clifton Road, Atlanta Georgia job site, employees were exposed to struck by hazards as they were permitted to walk in front of and in close proximity to a GEHL rough terrain forklift as it was in operation so as to steady equipment being moved on the forks of the forklift.
