Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees operating powered industrial trucks without using seat belts were exposed to the hazard of injury from tipover accidents which seat belts are designed to address: Throughout the facility, employees were exposed to the hazard of being pinned between a forklift and the ground in the event of a tipover, due to the fact that forklift operators were not required to wear the seat belts provided on the following forklifts: Clark Model #GCX25, Clark Model #GPS30, Hyster Model #E25XL, and Caterpillar Model #GP25. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require the use of the seat belts provided on the forklifts in accordance with ASME/ANSI B56.1-1995, Safety Standards for Low Lift and High Lift Trucks, Section 5.3.19.
