Text For Citation: 01 Item/Group: 001 Hazard: UNAPEQUIP
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to head and/or torso entrapment between the ground and the truck in the event of a tipover: (a) Building Number 5, Hyster H100E powered industrial truck; a retrofit program for the installation of an operator restraint system was not instituted by the Company. Among other methods, one feasible and acceptable method to correct this hazard is to institute a "restraint device", system or enclosure that is intended to assist the operator in reducing the risk of injuries in accordance with Paragraph 7.39 of ANSI B56.1d-1992 on all powered industrial trucks at this location.
