Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were permitted to ride in the bucket of a front end loader, exposing them to the hazard of being struck and crushed by a moving vehicle: (a) Location: Dudley Road, Bedford, MA; On or about 4/4/96, an employee was fatally injured on Dudley Road in Bedford, MA, when he fell out of the Case 580-E Front End Loader Bucket, ID #17042799 in which he was riding. Among other methods, feasible abatement methods include: 1. Develop and implement a comprehensive safety training program to be successfully completed prior to permitting employees to operate heavy equipment. 2. Prohibit the practice of allowing employees to ride in the bucket of a front end loader.
