Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: Employees are required to operate powered industrial trucks in this facility, and are/were not protected from serious injury from failure of braking and steering systems through a scheduled preventive maintenance program that would ensure that the carts are/were maintained in safe operating condition. Among other methods, one feasible and acceptable abatement method would to correct this hazard would be to implement a scheduled preventive maintenance program for the vehicles as required by the operators manuals and ASME/ANSI B56.8 - 1981 through 1993.
