Text For Citation: 01 Item/Group: 001 Hazard: FALLING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards from damaged ladder stand(s): a) Warehouse #1 -- an approximate 11-foot-high mobile ladder stand, company number 14 (no other identification), had one broken leg, and remained in use to access storage racks and pull orders. The first step had also been welded down, permanently locking the wheels, and negating the capability to easily move the unit from place to place. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO REMOVE DAMAGED OR WEAKENED UNITS FROM SERVICE UNTIL REPAIRS CAN BE COMPLETED, OR TO DESTROY THEM IF THEY ARE DAMAGED OR WORN BEYOND REPAIR. EMPLOYEES SHOULD ALSO BE INSTRUCTED BY THEIR EMPLOYER IN THE PROPER USE OF MOBILE LADDER STANDS, AND BE REQUIRED TO READ AND UNDERSTAND THE MANUFACTURER'S OPERATING INSTRUCTIONS BEFORE BEING ALLOWED TO USE ANY UNIT. IN ADDITION, UNITS MUST BE MARKED WITH THE MANUFACTURER'S NAME, THE MONTH AND YEAR OF MANUFACTURE, AND THE MAXIMUM RATED LOAD; THERE MUST ALSO BE LABELS WITH BRIEF INSTRUCTIONS REGARDING VISUAL INSPECTION, PROPER USE, AND MAINTENANCE. MANUFACTURER'S INSTRUCTIONS, INCLUDING VISUAL INSPECTIONS AND GENERAL MAINTENANCE, MUST BE ADHERED TO BY THE OWNER.
