Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a)Employees, including temporary labor employees, working as trash and recycle loaders, were exposed to the hazards of being struck by refuse trucks and/or other vehicular traffic. Among other methods, one feasible and acceptable method to correct this hazard is implementation of a training program to thoroughly train and familiarize workers with the safety procedures and safe work practices to be followed while working on the company's refuse trucks, including, but not limited to, the company backing policy, and personal protective equipment requirements.
