Text For Citation: 01 Item/Group: 001 Hazard: FALLING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On and before August 21, 1995, employees performing pavement construction activities on West 204th Street were subjected to the hazards of falling from the rear of moving pick-up trucks and striking the pavement or ground resulting in fractures, concussions, multiple internal injuries and or death while moving about the construction site riding on the tailgate or in the rear compartments of pick-up trucks. Among other methods, one feasible and acceptable method to correct the hazard is to follow the safety requirements provided hereinafter: (a)Prohibit employees from riding on motor vehicles or in the rear compartments of vehicles and pick-up trucks unless adequate seating systems are installed per 49 CFR 571.207 and occupant crash protection provided per 49 CFR 571.208. (b)Tools and materials transported in the same compartment with employees shall be secured to prevent movement. (c)Document and implement procedures for the above safe work practices and enforce these procedures.
