29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety On or about March 10, 2017 at 2910 North Druid Hills Roads, Atlanta, Georgia: where the competent person was aware of the existing hazardous conditions on site, an employee was allowed to work in an unprotected trench approximately 21 feet deep and was exposed to a cave in hazard when the sidewalk, parking lot, and spoil pile were not supported or placed in such a manner that it did not create a hazard to the employee working in the trench.
