Text For Citation: 01 Item/Group: 001 Hazard:
Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: (a) On or about February 28th, 2017 for the employee who was fatally injured after being pinned between two vehicles at 3401 Fourth Avenue South in Fargo, North Dakota. Abatement Note: Among other methods, feasible and acceptable abatement methods to correct the hazard would be for the employer to develop and implement a policy of using a spotter when backing up vehicles. Additional means of abatement could have included an alarm on the garage door or mirrors in within the garage bay.
