29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. On or about February 15, 2017, the employer did not ensure modifications that affected the safe operation of three Yale, Model OS030BF, High Lift Order Picker Rider Trucks, also known as cherry pickers, were performed with the manufacturers prior written approval. The employer removed the fall restraint tether line and safety harness anchor point bar from the trucks overhead guard.
