OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard from materials moved by a hoist. a) Storage Area: The employer did not ensure that metal bed frames weighing approximately 3600 pounds were free to move and clear all obstructions. On 2/22/2017, an employee was injured by falling metal bed frames that were knocked over by metal bed frames being transported by a Yale Hoist. b) Storage Area: The Yoke hooks used on a Yale Hoist were not equipped with a safety latch, on or about 2/22/2017.
