29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person. (a)Sorlien Electric, Inc. at 45959 280th St. Hurley, SD 57036: On and prior to December 29, 2016, the exposing employer did not initiate frequent and regular inspections of the job-site by a competent person to ensure employees are working safely. On 12/29/2016, an employee died as a result of injuries sustained from a fall after exiting the elevated scissors lift he was working from and walking on a 2x4 lying horizontally between pole barn trusses. The 2x4 broke and the employee fell approximately 21 feet. This condition exposed an employee to a fall hazard of approximately 21 feet. Sorlien Electric, Inc. was previously cited for a violation of the same or substantially similar condition of this Occupational Safety and Health Standard 29 CFR 1926.20(b)(2) which was contained in OSHA inspection number 1170933, Citation Number 1, Item Number 1, issued on September 8, 2016 and was affirmed as a final order on September 29, 2016 with respect to a workplace located at 236 S. Main Ave., Sioux Falls, SD 57104. Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.
