29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: (a) The employer did not implement a Hearing Conservation program with all of its requirements (such as provision of suitable hearing protectors, medical monitoring, recordkeeping, and training). An employee making pallets on the west side of the shop, using a nail gun, and helping with the table saw operation was exposed to a cumulative noise dose of 77.3% during a 466 minute sampling period on January 10, 2017. This noise exposure equated to an 8-hour time weighted average sound level of approximately 88.2 dBA; the 8-hour time weighted average determination included zero increment for the unsampled 14 minutes. b) The employer did not implement a Hearing Conservation program with all of its requirements (such as provision of suitable hearing protectors, medical monitoring, recordkeeping, and training). An employee building boxes at the east side of the shop, using a nail gun, and operating the "Run-A-Gade" was exposed to a cumulative noise dose of 123.5% during a 387 minute sampling period on January 10, 2017. This noise exposure equated to an 8-hour time weighted average of approximately 91.5 dBA; the 8-hour time weighted average determination included zero increment for the unsampled 93 minutes.
