OSH ACT of 1970 Section (5)(a)(1): The employer does not furnish employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to employees due to the employees operating nailguns in an unsafe manner and being exposed to struck-by and impalement hazards. Location: Facility 1) Employees are exposed to being struck by nails from nail guns they are operating; 2) Employees are exposed to being struck by nails from nail guns being operated adjacent to them; The violation was observed on October 31st, 2016, when an employee was struck in the cheek by a nail from his own nail gun. To abate this violation, the employer must ensure that employees are trained in the proper operation and safety practices of the nailguns they are using, and that nailgun work stations have effective barriers between each other. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance.
