29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when: This employer does not provide adequate cave in protection for employees working in excavations that are more than five feet deep and not in stable rock. This failure to provide adequate protection was recently demonstrated on May 10, 2016. a) On May 10, 2016 employees working in a trench located at 3301 Greenburg Rd. Beavercreek Ohio (Balleymeade Condos) were not adequately protected against cave-ins in that the walls of the trench were not properly sloped, shored, benched or otherwise adequately protected against a collapse.
