Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. On or about September 14, 2016 (which predated the effective date of 29 C.F.R. 1910.28) employees were exposed to a 4 foot, 4 inch fall hazard on the empty side of a double dock that was unoccupied and when the adjacent side of the double dock was in use. One feasible and acceptable means of abatement, among other methods, to correct this hazard at issue in this matter would be to install and use moveable guarding, a chain, or other protection on the open side of the loading/off-loading dock.
