Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the First Street Elementary School construction site, the operator of the Pettibone rough terrain high lift fork truck was observed traveling throughout the area with his seat belt unbuckled. This practice exposed the operator to the hazard of being ejected and crushed by the machine in a roll-over accident. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require the operator to wear his seat belt at all times when he is sitting in the seat of the powered industrial truck, regardless of the length of time that he will be in the seat, as warned by the manufacturer of the lift in a warning posted on the frame of the lift.
