Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At the First Street Elementary School construction site, the operator of the Pettibone rough terrain high lift fork truck, model 636, Serial number 636-210, and the operator of the GEHL rough terrain high lift fork truck, were observed traveling throughout the area with their seat belts unbuckled. This practice exposed the operators to the hazard of being ejected and crushed by the machine in a roll-over accident. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require the operators to wear their seat belts at all times when they are sitting in the seat of the powered industrial truck, regardless of the length of time that they will be in the seat, as warned by the manufacturer of the lift in a warning posted on the frame of the lift.
