Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck or run over by vehicular traffic while working in a private roadway: On the jobsite - The employee was exposed to being struck or run over by vehicles while working in the private roadway. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard is before work has begun in the vicinity of vehicular traffic which may endanger employees, warning signs and/or flags or other traffic control devices shall be placed conspicuously to alert and channel approaching traffic.ing
