29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (a) The employer is failing to protect employees exposed to the pulmonary stress of wearing a respirator while exposed to respirable crystalline silica. This was most recently noted on November 2, 2016, at 2100 Manchester Trafficway, Kansas City, Missouri, when an employee was overexposed to high levels of crystalline silica. The employee was mandated to wear a respirator. No written respiratory protection program had been developed or implemented. (1) On or about November 2, 2016, in the fabrication area, an employee was exposed to respirable crystalline silica while cutting, grinding, sanding and polishing stone counter tops. The employee was exposed to an 8-hour Time Weighted Average (TWA) of 1.42 milligrams respirable crystalline silica per cubic meter of air, which is 2.52 times the calculated OSHA Permissible Exposure Level (PEL) of 0.563 milligrams respirable crystalline silica per cubic meter of air. The Jericho Home Improvements was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.134(c)(1), which was contained in OSHA inspection number 953084, citation number 1, item number 2, and was affirmed as a final order on April 3, 2014, with respect to a workplace located at 2100 Manchester Trafficway, Kansas City, Missouri 64126.
