OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from crushing injuries from the failure to utilize safety restraint devices and rollover protection structure (ROPS) while operating mowers and tractors: a) Jobsite at W. Bayfront Parkway and Niagara Pointe Drive in Erie, PA. On August 22, 2016, an employee was exposed to crushing hazards while operating the eXmark Lazer Z X-Series riding lawnmower without the rollover protective structure (ROPS) in the raised position. b) Jobsite at W. Bayfront Parkway and Niagara Pointe Drive in Erie, PA. On August 22, 2016, an employee was exposed to crushing hazards while operating an eXmark Lazer Z X-Series riding mower without utilizing the seatbelt when operating the lawnmower.
