29 CFR 1926.52(d)(1): In all cases where the sound levels exceeded the values shown in Table D-2 of 29 CFR 1926.52, a continuing, effective hearing conservation program was not administered to address annual audiometric testing, noise exposure assessment, and required training: The employer is failing to protect employees from hazardous sound levels. On and about 09/13/2016 employees working at the Third Street Bridge Viaduct project in St. Louis, Missouri performed concrete chipping activities. (a) An employee was exposed to continuous noise levels at 438.3 % of the allowable 8-hour time weighted sound level (90 dBA). The equivalent dBA level of 438.3 % is approximately 100.7 dBA. Sampling was performed for 407 minutes during one shift. This condition exposed the employee to occupationally related noise-induced hearing loss. (b) An employee was exposed to continuous noise levels at 410.8 % of the allowable 8-hour time weighted sound level (90 dBA). The equivalent dBA level of 410.8 % is approximately 100.2 dBA. Sampling was performed for 369 minutes during one shift. This condition exposed the employee to occupationally related noise-induced hearing loss. (c) One employee was exposed to continuous noise levels at 356.4 % of the allowable 8-hour time weighted sound level (90 dBA). The equivalent dBA level of 356.4 % is approximately 99.1 dBA. Sampling was performed for 407 minutes during one shift. This condition exposed the employee to occupationally related noise-induced hearing loss.
