OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards while performing pre-trip inspections of semi-tractor trailers: On or about July 29, 2016 and dates prior thereto, employees engaged in performing coupling operations of semi-trucks and trailers were exposed to struck-by hazards while performing pre-trip inspections of trucks that were not secured against movement before exiting the vehicle to complete the coupling process and perform the DOT driver vehicle report. "Ensure that the employer's work rule to use only the trailer's crank to make height adjustments during the coupling procedure is rigorously enforced, with adequate disciplinary measures imposed on any violators."
