Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On or about April 19, 1995, at Woodside Trail, Jupiter, Florida, 33458, the Mack Truck License #M6616D, was backing to a pick up area where view to the rear was blocked, thus exposing employees at the rear to the hazard of being struck. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: (1) While backing, dump men should be visible at all times; (2) When view to the rear is blocked, vehicle shall stop and be directed; (3) A written procedure shall be established for backing and observing dump-men; (4) Employer to monitor employee's operation of the equipment in the field.
