Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: An accident occured on/or about October 23, 1996, at 4401 Savanna Street, Fort Smith, Arkansas 72903, two employees were operating Yale Fork Lifts which were not equipped with seat belts or other type of restraint devices, exposing the employees to the hazards of being thrown from and being crushed by the Fork Lifts. Among other methods, one feasible and accepted abatement methods to correct this hazard is: Install safety seat belts or other approved types of restraints to protect the employees from being thrown from the Fork Lifts.
