Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to the hazard of: (a) being struck by falling cargo and/or rigging, TUG operators were observed driving under cargo loads as soon as there was enough clearance to pass under the cargo carrier. The TUG(s) were not provided with overhead guards to protect the operators from falling cargo and/or rigging, on or about 9/25/96. In the event that removing the TUG operators from the overhead hazard is unavoidable, among other methods, one feasible and acceptable abatement method to correct this hazard is to install overhead protective cages on the TUG(s). Reference is made to 29 CFR 1917.43(e)(1)(i) "Powered Industrial Trucks","Overhead Guard", which states: "When operators are exposed to overhead hazards, the employer shall ensure that fork lift trucks are equipped with securely attached overhead guards."
