Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards referenced by ANSI B20.1-1996 Safety Standards for Conveyors and Related Equipment: a) Throughout Production Area - Employees are exposed to the hazard of being struck by falling boxes off unguarded conveyors and the hazard of being caught in unguarded moving parts of conveyor system installed 3'6" above exit passageway and on aisleways. Feasible methods of abatement are: 1) Install spill guards, pan guards, or equivalent to protect employees from product falling off conveyors. 2) Conveyors installed above exit passageways, aisles, or corridors, there should be a minimum clearance of 6'8" measured vertically from the floor or walking surface to the lowest part of the conveyor or guard. 3) Where conveyor system function will be impaired by providing the minimum clearance of 6'8" through an emergency exit, alternate passageways should be provided. 4) Implement routine inspections, preventive and corrective maintenance program, to insure that all safety features and devices are retained and conveyors function properly. 5) The area around the conveyors loading and unloading points should be kept clear of obstructions which could endanger employees.
