Section 5 (a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to crushing and struck by hazards from unexpected rolling and/or movement of equipment. Betty's Neck Farm: On March 5, 2002 an employee was crushed to death when the John Deere front end loader he had dismounted from suddenly and unexpectedly moved forward and crushed him to death. The emergency brake on the front end loader was inoperative. Feasible and useful methods to correct this hazard, among other methods are as follows: 1)Repair the emergency brake on the John Deere JD 544-A front end loader. 2)Establish a preventative maintenance program for all the farm and construction equipment owned by the corporation.
