Section 5(a)(1) of the Occupational Safety & Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to the hazards of having part of their body caught between the moving elevator and the hoistway and the opening(s) in the shaftway doors. Warehouse: 1) The car gate on the freight elevator was damaged and would not close exposing the emloyee(s) to serious injuries. 2) The opening in the basement shaftway door was not guarded. One method, among other methods, to correct the condition is to replace the elevator car gate and guard the opening in the basement shaftway door.way
