Section 5 (a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees who operated forklift trucks were exposed to crushing injuries in the event that the forklift truck overturned. Production Department: The operators of the seven Toyota forklift trucks were not wearing the seat belts provided exposing them to serious crushing injuries. One method, among other methods, to correct the condition is to ensure the forklift operators to wear their seatbelts.
