Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard from the personnel platform. (a) On or about April 27, 1995, employees were exposed to a fall hazard from the personnel platform, in that, no standard guardrail was provided on the platform, the platform was not secured to the lifting carriage or forks of the forktruck and no other personal fall protection equipment was in use. Among other methods, one feasible and acceptable abatement method to correct this hazard is to install a standard guardrail across the front side of the platform and secure the platform to the lifting carriage or forks in accordance with ASME/ANSI B56.6-1987, Safety Standard for Rough Terrain Forklift Trucks, Part III, section 8.25.1(m), and 8.25.1(f).
