Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall of 22 feet while working from an unsafe platform: (a)Fenton Construction Co., at 3884 Woody Creek Road, Woody Creek, CO 81656: The controlling employer did not ensure the employees did not work from an unsafe platform held aloft by a rough terrain forklift in that two employees worked at approximately 22 feet high on a job made platform. This condition exposed the employees to hazards of fall of approximately 22 feet. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide a personnel platform which complies with the design requirements as per ASME B56.6-1992, The American Society of Mechanical Engineers - An American National Standard - Safety Standard for Rough Terrain Forklift Trucks, paragraphs 5.15 and 8.25.
